CompenAir operates on a strictly no-win, no-fee basis. You pay nothing unless we successfully recover compensation on your behalf. Our fee is 25% (inclusive of VAT) of the compensation amount recovered. Compensation is paid to CompenAir first; we then transfer your share to you within 14 business days.
These Terms of Service ("Terms") govern the relationship between CompenAir Limited ("CompenAir", "we", "us") and you ("the Client") when you use our flight compensation claims service. By submitting a claim and signing the Letter of Authority, you agree to these Terms.
CompenAir Limited is a claims management company registered in Ireland. We are not a law firm and do not provide legal advice. We act as claims management agents, pursuing flight compensation claims on behalf of passengers under EU Regulation 261/2004 and applicable Irish and European law. CompenAir acts as agent on your behalf — the claim remains yours at all times.
When you submit a claim and sign the Letter of Authority, CompenAir will, acting as your agent:
We reserve the right to decline any claim at our discretion, including where we assess the claim has a low likelihood of success. We will notify you if we decline to pursue your claim.
Please note: CompenAir is not authorised to represent clients in court proceedings. If court action is required to recover your compensation, we will advise you to seek independent legal advice.
Before we can act on your behalf, you must sign a Letter of Authority ("LOA"). The LOA authorises CompenAir to correspond with the airline, receive communications, and accept compensation on your behalf as your agent. No action will be taken on your claim until a signed LOA is received. The LOA does not transfer ownership of your claim to CompenAir — you remain the claimant at all times.
By submitting a claim you confirm that:
You agree to provide any additional information or documentation we reasonably request and to respond to our communications within 14 days. Failure to respond may result in us closing your claim.
CompenAir operates on a no-win, no-fee basis:
For example: if we recover €400 compensation, our fee is €100 and you receive €300.
There are no hidden charges, administration fees, or upfront costs of any kind. Your fee liability is limited strictly to 25% of any compensation actually recovered.
Once compensation is received from the airline, CompenAir will contact you to confirm your bank account details. We will transfer your share within 14 business days of receiving your confirmed account details. CompenAir is not responsible for delays caused by incorrect or incomplete bank details provided by the client. If we are unable to contact you within 90 days of receiving your compensation, we will make reasonable efforts to locate you before holding the funds in accordance with applicable Irish law.
EU Regulation 261/2004 does not apply where a flight disruption was caused by extraordinary circumstances that could not have been avoided even if all reasonable measures had been taken. Examples include severe weather, air traffic control strikes, security incidents, and other events outside the airline's control.
If an airline rejects your claim on the grounds of extraordinary circumstances, CompenAir will review the airline's stated reasons and assess whether the rejection is valid. If we determine the extraordinary circumstances defence is legitimate and the claim cannot be successfully pursued further, we will notify you in writing. In such cases no fee is payable to CompenAir.
Where an airline's extraordinary circumstances defence is rejected by CompenAir as invalid, we will continue to pursue your claim. However, if the claim ultimately fails on those grounds, it remains the client's decision whether to pursue the matter independently through the courts or other channels. CompenAir cannot represent clients in court proceedings.
Under EU consumer law you have the right to cancel this agreement within 14 days of signing the Letter of Authority without giving any reason ("cooling-off period"). To cancel, contact us at hello@compenair.com within 14 days.
You may also withdraw your claim at any time after the cooling-off period by contacting us in writing. If you withdraw after we have submitted your claim to the airline and compensation is subsequently paid as a direct result of our submission, our 25% fee remains payable.
If you are unhappy with how we have handled your claim, please contact us in the first instance at hello@compenair.com. We will acknowledge your complaint within 5 business days and provide a full written response within 28 days.
If you remain unsatisfied after our response, you may refer your complaint to the Competition and Consumer Protection Commission (CCPC) at ccpc.ie, or seek independent legal advice. We are committed to resolving all disputes fairly and promptly.
Nothing in these Terms affects your statutory rights as a consumer under Irish law.
CompenAir's total liability to you under these Terms is limited to the amount of any compensation received by CompenAir on your behalf that we have failed to transfer to you in accordance with these Terms. We are not liable for the outcome of any claim, for any airline's decision, or for any indirect or consequential losses.
These Terms are governed by the laws of Ireland. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the Irish courts.
We may update these Terms from time to time. Any changes will be posted on this page with an updated date. Changes will not affect claims already in progress at the time of the change.
